Exclusion of the Right of Withdrawal
According to Article 59, letter o) of Legislative Decree no. 206 of 2005, and its subsequent amendments, known as the “Consumer Code,” the right of withdrawal is explicitly excluded in relation to the supply of digital content delivered through non-material means. This is particularly relevant to the digital products sold through our website. Unlike physical goods, digital content is considered consumed upon delivery and cannot be returned once accessed or downloaded. As a result, customers do not have the right to withdraw from the purchase of digital products provided through our site.
The exclusion of the right of withdrawal for digital content is designed to protect the integrity of digital transactions. Given that digital products, such as software, eBooks, or streaming services, are typically delivered instantly upon purchase, the opportunity for unauthorized use or duplication before returning the product poses significant risks. Therefore, the law recognizes the need to prevent misuse and establishes that once a digital product has been accessed, the sale is final.
Legal Guarantees of Conformity
When you purchase products through our site, you are entitled to the legal guarantees of conformity as outlined in the Consumer Code and aligned with European Directives 770/2019/CE and 771/2019/CE. These legal guarantees ensure that the products you receive conform to the description provided, are fit for the purpose for which such goods are typically used, and exhibit the quality and performance that is reasonably expected.
If a product you purchase is found to be defective or not in conformity with the agreed terms, you have the right to have the defect corrected in accordance with the remedies provided by the Consumer Code. The legal guarantee of conformity covers any lack of conformity that arises within 24 months from the date of delivery of the product. However, it’s important to note that your right to claim for this lack of conformity is subject to a statute of limitations, which requires you to take action within 26 months from the delivery date.
Reporting Defects and Non-Conformities
Should you discover a defect or non-conformity in a product you have purchased, it is crucial to report this promptly to ensure your claim is processed efficiently.
